1. Who you're contracting with
BONKO ("we", "us", "our") is operated by Bonko. By creating an account or using the BONKO service (the "Service"), you agree to these Terms & Conditions. If you don't agree, don't use the Service.
2. The Service
BONKO is a fitness, nutrition, and habit-tracking app that includes workout and meal plans, an AI coach, progress analytics, and community features. We may add, change, or remove features at any time.
3. Eligibility & account
You must be at least 16 years old (or the age of digital consent in your country) and provide accurate registration information. You are responsible for activity under your account and for keeping your credentials confidential. If you're using BONKO on behalf of an organization, you confirm you have authority to bind it.
4. Acceptable use
You agree not to: (a) use the Service unlawfully or fraudulently; (b) send spam, malware, or harmful content; (c) infringe anyone's intellectual property; (d) probe, scan, scrape, or interfere with the security or integrity of the Service; (e) reverse engineer, resell, or redistribute the Service; or (f) circumvent technical limits or usage quotas.
5. AI features & health disclaimer
The AI coach and meal-photo analysis generate outputs that may be inaccurate or incomplete. BONKO is not a substitute for professional medical, nutritional, or fitness advice. Always consult a qualified professional before starting a new program, especially if you have health conditions, are pregnant, or take medication. You are responsible for how you use AI outputs and for verifying their accuracy. You must have the rights to any content you submit (photos, descriptions). We may remove, restrict, or refuse outputs and may suspend accounts that misuse AI features.
6. User content
You retain ownership of content you submit (posts, photos, logs). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content solely to operate and improve the Service.
7. Intellectual property
BONKO, its software, branding, designs, and documentation are owned by Bonko or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
8. Payments, subscriptions & refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, see the Paddle Buyer Terms and our Refund Policy. Subscriptions renew automatically until canceled.
9. Service level
We work hard to keep the Service available but do not guarantee uninterrupted or error-free operation. We may perform maintenance, change, or discontinue features at any time.
10. Suspension & termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, create security or fraud risk, or repeatedly or seriously violate our policies. You can cancel anytime via the customer portal. On termination, you may export your data within 30 days, after which we may delete it.
11. Warranties & liability
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind. Our aggregate liability for any claim is capped at the fees you paid us in the 12 months before the claim. We exclude liability for indirect, consequential, or special damages (lost profits, data, goodwill). Nothing here excludes liability for fraud, death, or personal injury caused by negligence where the law does not permit it.
12. Indemnity
You agree to indemnify BONKO and Bonko against claims arising from your user content, your unlawful use of the Service, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the seller's jurisdiction. Disputes will be resolved in the competent courts there, unless a mandatory consumer protection law in your country provides otherwise.
14. Changes
We may update these Terms. Material changes will be announced in-app or by email. Continued use after changes take effect means you accept them.
